Underage Drinking and Fake IDs

Just pleading guilty in an underage drinking or fake ID case is not wise, because you are at the mercy of the judge. Depending on his or her temperament, you may be sentenced to up to six months in jail and receive a fine of up to $1,000. You will also have a criminal record. Penalties for second and third offenses are more severe.

Having legal representation tells the judge you are taking the matter seriously. I will seek to obtain a dismissal of the charge if that is possible, or seek an outcome that mitigates any penalties you incur. In many cases involving underage drinking and the use of fake IDs, I have been able to obtain probation with no jail time for my clients.

Fortunately, a first-time offense is expungeable. After your case is resolved, I can seek to obtain an expungement which legally allows you to say "no" to the question "have you ever been convicted of a crime".
